A. Terms of Use

Purpose

This document aims to establish the General Terms and Conditions for Access and Use of the CENTURY 21 Portugal ® website and other portals owned by CENTURY 21 Portugal. CENTURY 21 Portugal reserves the right to unilaterally modify these General Terms and Conditions of Access and Use to align them with current legislation. These General Terms and Conditions of Access and Use do not exclude the possibility that certain site services, due to their particular characteristics, may be subject to Specific Conditions. The user’s use of any of the services on the CENTURY 21 Portugal website implies acceptance and express adherence to the General Terms and Conditions of Access and Use, in the version published on this website on the date of access, as well as to any other applicable Specific Conditions indirectly.

The information on the CENTURY 21 Portugal website regarding each property is provided by each CENTURY 21 Portugal agency, each of which is legally and financially independent, and therefore CENTURY 21 Portugal cannot be held responsible for such information and/or content. The information provided is for informational purposes only and may include images, plans, photographs, characteristics, construction projects, prices, and area, among other details. It does not constitute a contractual offer for the purposes hereof, and is not exhaustive nor intended to be so; thus, it does not dispense with consulting the respective legislation and competent entities. All data on properties provided by the CENTURY 21 Portugal website, except for typographical errors, are the responsibility of the CENTURY 21 Portugal agencies. Furthermore, CENTURY 21 Portugal disclaims any liability for the content of websites of various agencies that are part of the CENTURY 21 Portugal Network and its agents. These agencies are responsible for verifying the accuracy of their content, and final approval must be obtained from the property owner and/or their legal representative. It is also the responsibility of the CENTURY 21 Portugal agency to ensure compliance with all legal obligations, particularly concerning data protection, credit intermediation, and any other applicable regulations. CENTURY 21 Portugal shall not be liable for the availability of content on websites to which it has established hyperlinks and expressly disclaims any liability regarding such sites. Consequently, CENTURY 21 Portugal shall not be liable in any form for any direct, indirect, incidental, or collateral damage resulting from visits to its pages, including but not limited to loss of data, loss of revenue, or other profits, and interruption of business processes due to the use or inability to use the information provided on this site.

General User Conduct

The user, in accordance with the law and these Terms of Use, agrees not to use the site in any way that might infringe the legally protected rights of CENTURY 21 Portugal or third parties. The user also agrees to use the site responsibly, prudently, and carefully, and to refrain from disturbing or degrading the continuity, integrity, and quality of the site’s resources and functionalities. The user must refrain from attempting to obtain information, messages, graphics, designs, sound and/or image files, photographs, recordings, videos, and software or any other type of material or content available on the site by means or procedures other than those made available or commonly used on the Internet for such purposes; in no case shall they use a method that affects the functionality of the site or any application. Except when authorized by CENTURY 21 Portugal, the user shall not use or commercially exploit, in any form or medium, the services, including its content, materials, features, or resources.

General User Responsibility

The user is solely responsible for all content, information, data, communications, including attachments, materials, etc., provided in any form via the CENTURY 21 Portugal website or stored on its servers. The user is obligated to obtain the necessary authorizations before using or providing, in any form, materials subject to intellectual property rights or other types of rights – such as image rights – of CENTURY 21 Portugal or third parties. CENTURY 21 Portugal reserves the right, at any time, to modify and/or delete any content on the CENTURY 21 Portugal website without prior notice.

B. Privacy Policy

The services available to you on this electronic platform are provided by CENTURY 21 Portugal, which is committed to respecting your privacy regarding the data you submit here. This commitment is equally applicable to all new services that may be offered on these electronic platforms, which must strictly adhere to the Privacy Policy and General Terms of Access and Use expressed in this document.

CENTURY 21 Portugal has simplified the entire process as much as possible; however, if you are unfamiliar with terms like cookies, IP addresses, pixel tags, and browsers, please first review the definitions and explanations of these keywords. CENTURY 21 Portugal values the security and privacy of its users, so whether you are a new or long-term user, take some time to review our practices, and if you have questions, consult this page.

Access to certain areas of the website and/or other applications is only possible through user registration. The personal and other information collected during user registration is intended exclusively for processing purposes and only within the scope of the services requested by the user on the website www.century21.pt and the CENTURY 21 ® APP. By registering, the user commits to providing CENTURY 21 Portugal with accurate and complete information, particularly an email address, and to notify CENTURY 21 Portugal of any changes to the provided information. The user may access their data online or, if desired, request access in writing, verify its accuracy, and, if necessary, correct it. To do this, they should use the online option available or contact rgpd@century21.pt.

CENTURY 21 Portugal is committed to complying with current legislation regarding personal data protection and will not transfer this information to other entities in any form or under any condition, except in cases where the respective data subject consents and authorizes or where there is a legal obligation to do so. CENTURY 21 Portugal also undertakes to adopt the necessary security measures to ensure the protection of users’ personal data against possible misuse or unauthorized access.

1. Confidentiality

1.1. Registration Information

Due to the nature and purposes of the interactive services offered here, users are required to provide information that may be considered personal. Our services will always comply with the provisions of the Personal Data Protection Law – Law No. 67/98, of October 26.

Only the data necessary for providing CENTURY 21 Portugal’s services and those of other entities with whom it contracts will be requested and collected, according to the information explicitly provided on the site and user options. The personal information provided is intended for the exclusive use of CENTURY 21 Portugal and other entities with whom it contracts, in accordance with the specific purposes of each case.

1.2. Use of Collected Information

When a user uses our services or views content provided by CENTURY 21 Portugal, we may automatically collect certain information in server logs, which may include details about how services are used, such as search queries; the IP address, and cookies that can uniquely identify the browser or the user account.

When using a CENTURY 21 Portugal service with location-enabled functionality, we may collect and process information about the user’s current location, such as GPS signals sent by a mobile phone. We may also use various technologies to determine location, such as device sensor data, which may, for instance, provide information about nearby Wi-Fi access points and cell towers.

When a user contacts CENTURY 21 Portugal, we may keep a record of the communications to help resolve any issues that may arise. We may use the user’s email address to send information about our services, notifying them, for example, of future changes or improvements.

When a user utilizes the CENTURY 21 APP or CENTURY 21 Portugal services within the scope of Credit Intermediation services, we may collect and process personal information, such as identification data, affiliations, address, credit, professional, asset, and financial information (income or liabilities in the financial sector), which is provided by users through the completion of forms for the purpose of service provision. Data may be collected directly by CENTURY 21 Portugal or through credit intermediaries or partners through whom the operations/services are presented to CENTURY 21 Portugal for decision/approval and contracting.

We use information collected from cookies and other technologies, like pixel tags, to improve the user experience and the overall quality of our services. For example, by saving a user’s language preferences, we can present our services in their preferred language.

We will request user consent before using information for purposes other than those outlined in this Privacy Policy.

CENTURY 21 Portugal processes personal information on the company’s servers in various countries worldwide. We may process a user’s personal information on a server located outside their country of residence. CENTURY 21 Portugal guarantees all its users that no personal data will be provided to third parties without the prior consent of the data subject or without a legal obligation to do so. CENTURY 21 Portugal reserves the right to provide aggregated data (such as locality, age, and/or others) for purposes deemed of public utility, particularly for statistical production. CENTURY 21 Portugal does not share personal information with companies, entities, and individuals outside CENTURY 21 Portugal, except in the following circumstances:

1.2.1. With User Consent

We will share personal information with companies, organizations, and individuals outside CENTURY 21 Portugal if we have the user’s consent to do so. We request explicit consent for sharing any sensitive personal information.

1.2.2. With Domain Administrators

If the CENTURY 21 Portugal Account is managed by a domain administrator (e.g., in the case of CENTURY 21 Portugal Apps users), the domain administrator and resellers providing user support to the company will have access to the CENTURY 21 Portugal account information (including email and other data). The domain administrator may be able to:

view account statistics, such as application-related statistics; change the account password; suspend or terminate the user’s access to the account; access or retain information stored as part of the account; receive account-related information to comply with any applicable law, regulation, legal process, or enforceable government request; restrict the user’s ability to delete or edit information or privacy settings.

1.2.3. For Legal Reasons

As part of Credit Intermediation and in compliance with Anti-Money Laundering regulations, CENTURY 21 Portugal is legally required to report client personal data related to their identity, credit obligations, and respective income to regulatory authorities overseeing its activities and to other public/official entities, including the following:

  • Banco de Portugal;
  • Institute of Public Markets, Real Estate, and Construction (IMPIC), as stipulated in the Anti-Money Laundering and Terrorism Financing Law;
  • Central Department of Investigation and Criminal Action (DCIAP), Financial Intelligence Unit, and other judicial, law enforcement, and sectorial authorities as stipulated in the Anti-Money Laundering and Terrorism Financing Law.

Additionally, CENTURY 21 Portugal utilizes service providers who may have access to clients’ and/or users’ personal data. In these cases, CENTURY 21 Portugal ensures that all appropriate technical and organizational measures are taken to guarantee that subcontracted entities with data access are reputable and offer the highest level of assurance, ensuring compliance with applicable data privacy and protection legislation, including the exercise of data subjects’ rights.

Furthermore, CENTURY 21 Portugal has commercial partnerships with certain entities through which it grants its clients and/or users certain advantages or benefits. With client consent, CENTURY 21 Portugal may transfer client and/or user data to these commercial partners to allow them to offer related products or services. In any case, clients always retain the right to withdraw their consent for data sharing.

We will share information with companies, organizations, or individuals outside CENTURY 21 Portugal if we believe in good faith that access, use, preservation, or disclosure of such information is reasonably necessary to:

  • comply with any applicable law, regulation, legal process, or enforceable governmental request;
  • enforce the Terms of Use, including investigating potential violations thereof; detect, prevent, or otherwise address technical, fraud, or security issues;
  • protect against harm to the rights, property, or safety of CENTURY 21 Portugal, its users, or the public, as required or permitted by law.

We may share aggregated information that does not include personally identifiable information publicly and with our partners, such as publishers, advertisers, affiliated websites, and/or others as applicable.

If CENTURY 21 Portugal becomes involved in a merger, acquisition, or asset sale, we will continue to ensure the confidentiality of all personal information and will notify affected users before personal information is transferred or becomes subject to a different privacy policy.

By requesting information via the CENTURY 21 Portugal website, mobile applications, or other platforms and submitting personal data for this purpose, you consent to our sharing this data with companies, organizations, and individuals outside CENTURY 21 Portugal for marketing or other related purposes.

C. Data Protection

As of May 25, 2018, Regulation (EU) 2016/679, dated April 27, 2016, regarding the protection of natural persons concerning personal data processing and the free movement of such data, is applicable for the processing of personal data.

This legal provision applies solely to personal data concerning natural persons, which includes individuals in executive functions or roles in Corporate Clients, legal representatives, and individual business owners.

The purpose of this information is to inform users about the new rules applicable to the processing of their personal data, their rights, and how they can manage their respective consents directly and simply.

For the purpose of sending you information about CENTURY 21 Portugal or other institutional or commercial information (“Processing Purpose”), REDE GLOBAL, S.A. is the entity responsible for processing personal data and ensuring the protection of your privacy, acting in accordance with the law and the new Regulation.

All Personal Data will be retained by the Data Controller as long as the existing relationships between the user and REDE GLOBAL, S.A. persist or while the purpose for which they were collected remains valid (“Retention Period”). Collected data will be destroyed at the end of its legal retention period, being kept only for the time necessary and appropriate for the intended purposes, in accordance with applicable law, or as long as the consent for the “processing purpose” remains valid.

CENTURY 21 Portugal has always adhered to legal standards regarding the processing and privacy of personal data for its clients, a commitment now reinforced by the new legislation, which increases security and control in data protection.

We remind you that, at any time and without any cost, you can exercise your right to withdraw previously granted consent, request access to your personal data and information about its processing, ask for correction, modification, restriction, anonymization, or deletion of your personal data, request an explanation regarding the processing, and file a complaint with the supervisory authority. Furthermore, when a personal data breach poses a high risk to the rights and freedoms of natural persons, you will be promptly informed of the incident without undue delay.

These rights can be exercised by emailing rgpd@century21.pt or by sending a letter to the above address, addressed to the Personal Data Protection Officer of CENTURY 21 Portugal (REDE GLOBAL, S.A.).

2. Security Measures for Processing

CENTURY 21 Portugal adopts organizational and technological security standards and effective information security management practices to protect the confidentiality, integrity, and availability of information, providing confidence in inter-organizational exchanges involving CENTURY 21 Portugal, specifically community standards, and national legislation and recommendations in information security. Specifically:

  • We encrypt many of our services using SSL.
  • We offer two-step verification for access to the CENTURY 21 Portugal Account (both the website and the CENTURY 21 APP) and a Safe Browsing feature;
  • We regularly review our information collection, processing, and storage practices, including physical security measures, to prevent unauthorized access to systems;
  • We restrict access to personal information to CENTURY 21 Portugal employees, contractors, and agents who need to know the information for processing purposes and who are subject to strict contractual confidentiality obligations, which may lead to disciplinary or contract termination in the event of non-compliance.

3. Access, Security, and User Identification

Subscription to the services of CENTURY 21 Portugal’s electronic platforms requires knowledge and acceptance of the terms in this privacy policy and the assignment of an access password (password).

This document (“Privacy Policy and Terms of Use of CENTURY 21 Portugal”) will be presented to you during the subscription process, requiring your formal acceptance in order for the process to continue. You should cancel the process if you do not agree with the terms of this document or if you have doubts that you wish to clarify beforehand.

The password is generated and assigned by CENTURY 21 Portugal, following a process that ensures full confidentiality, and is unique, personal, and non-transferable. The user is responsible for the proper use and confidentiality of this password.

The password holder can change it to a combination of characters of their choice through the “Change Password” option available on the CENTURY 21 Portugal platforms, in the user identification section. It is advisable to choose a password that cannot be easily guessed by third parties. For example, avoid using easily accessible identification data such as your birth date, and use a combination of uppercase and lowercase letters along with numeric characters.

4. Changes to the Privacy Policy

If these conditions are modified, for example, due to the availability of new services or changes in the legislation governing these matters, they will be disclosed through CENTURY 21 Portugal.

If you do not agree with the changes made, you should immediately request the deletion of your personal data as outlined above.

5. Acceptance and Binding Agreement

You must follow all the policies provided to you in the Services. Do not misuse our Services. For example, do not interfere with our Services or attempt to access them through methods other than the interface and instructions we provide. You may use our Services only as permitted by law, including applicable export control and re-export laws and regulations. We may suspend or stop providing the Services to you if you do not comply with our terms or usage policies, or if we are investigating possible misconduct.

Using our Services does not grant you any intellectual property rights over our Services or the content accessed. You cannot use content from our Services unless authorized by the respective owner or under circumstances allowed by law. These terms of use do not grant you the right to use any of the trademarks or logos used in our Services. You should not remove, hide, or alter any legal notice displayed on our Services or alongside them.

Our Services may include content that does not belong to CENTURY 21 Portugal. This content is the sole responsibility of the entity providing it. We may evaluate content to determine if it is illegal or violates our policies and may remove or refuse to present content that, in a reasonable manner, we believe violates our policies or the law. However, this does not necessarily mean that we evaluate the content, so you should not assume that we do.

We may send you service ads, administrative messages, and other information related to your use of the Services. You can choose to opt out of receiving some of these communications.

Some of our Services are available on mobile devices. Do not use these Services in a way that distracts you and prevents you from complying with road safety laws or regulations.
